DISTANCE SALES AGREEMENT

This is a Sales Agreement in the Virtual Environment between Sanemiko Tasarım Danışmanlık ve İletişim San. Tic. Ltd. Şti. and the Customer.

Users are deemed to have read and approved the sales agreement as soon as they complete their order confirmation processes.

Article 1

The subject of this agreement is the scope of the rights and obligations of the parties in relation to the sale and delivery of the product, whose characteristics and sales price are specified below, sold by the seller to the buyer, in accordance with the provisions of the Regulation on the Principles and Procedures for the Application of Distance Contracts of Law No. 60502 on the Protection of Consumers.

Article 3 - BUYER INFORMATION

All members: All buyers who are members of Sanemiko Tasarım Danışmanlık ve İletişim San. Tic. Ltd. Şti.'s e-commerce store sanemiko.net and make purchases. (Hereinafter referred to as the buyer or customer.)

Article 4 - SUBJECT OF THE AGREEMENT AND PRODUCT INFORMATION

The Type, Quantity, Brand/Model, Color, Number, Sale Price, and Payment Method of the Good/Product or Service are as stated on the site, and these promises may change without prior notice to the buyer.

Article 5 - GENERAL PROVISIONS

5.1 - The BUYER declares that they have read and are informed of all preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the contract specified in Article 4, and that they have provided the necessary confirmation electronically.

5.2 - The product subject to the contract is delivered to the buyer or the person or organization at the address indicated by the buyer within the period explained in the preliminary information, depending on the distance of the buyer's place of residence, provided that it does not exceed the legal 30-day period for each product.

5.3 - If the product subject to the contract is to be delivered to a person or organization other than the buyer, the SELLER cannot be held responsible for the refusal of delivery by the person or organization to be delivered.

5.4 - The SELLER is responsible for delivering the product subject to the contract in a sound, complete manner, and in accordance with the qualifications specified in the order. The SELLER may supply different product/s of equal quality and price by informing the BUYER and obtaining explicit consent before the expiration of the performance obligation arising from the contract.

5.5 - For the delivery of the product subject to the contract, it is mandatory that this agreement be approved electronically and that the sales price be paid by the payment method preferred by the buyer. If the product price is not paid for any reason or is canceled in bank records, the SELLER is deemed to be released from the obligation to deliver the product.

5.6 - If the relevant bank or financial institution does not pay the product price to the SELLER due to the unauthorized, wrongful, or unlawful use of the buyer's credit card by unauthorized persons after the delivery of the product, without any fault of the buyer, the BUYER must send the product delivered to them or to the person or institution specified in the sales contract to the SELLER within 3 business days. In such a case, the shipping costs belong to the buyer.

5.7 - In case the products delivered to the BUYER and/or the person and/or institutions requested by the BUYER for delivery are defective, the SELLER undertakes to perform the necessary repair or replacement within the warranty conditions. The relevant product or products are sent to the SELLER within 20 business days starting from the date of receipt by the BUYER, and the shipping costs are covered by the SELLER.

5.8 - This agreement becomes valid after it is approved electronically by the buyer.

Article 6 - AUTHORIZED COURT

In the application of this agreement, Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Trade, and CONSUMER COURTS at the place of residence of the BUYER or SELLER are authorized. In case the order is approved electronically, the BUYER is deemed to have accepted all provisions of this agreement.
